1–2. The Promoter & The T&Cs
1. The promoter of all competitions on our website is Lucky Breaks Ltd, Company No. 17398897.
Registered Address: Bartle House, Oxford Court, Manchester, United Kingdom, M2 3WQ. Email: [email protected]. The address of the Competition Manager for the purposes of Schedule 1 is the same address above. "Paragraph" means a paragraph in the T&Cs.
2. The T&Cs apply to all competitions advertised on our Website. By submitting an entry, you agree to be bound by the T&Cs in force at that time. We may update the T&Cs, so please check them every time you use our Website.
3. The Competition
3. We run various competitions on our Website from time to time. The details of each competition are as described on the relevant Competition Page, which may also state the maximum number of entries we will accept before we close the Competition.
4–16. How to Enter
4. The Competition will be open until the date and time ("the Closing Date") shown on the Competition Page.
5. All entries must be received by the Closing Date. Any entries received after the Closing Date will be automatically disqualified.
6. Each entry is represented by a unique Entry Number. To obtain an Entry Number, two routes are available:
Paid online competition — You enter online via the Competition Page by paying the stated price per entry, either choosing or being allocated an Entry Number. You must open a free online account and register your details.
Free postal competition — You enter for free by complying with the postal entry requirements in Schedule 1. You must open a free online account via the Competition Page and register your details.
By entering, you create a legally-binding contract with us subject to the T&Cs. We recommend you retain a copy for future reference.
7. The winner will be selected from all Entry Numbers by a random number generator (currently randomdraws.co.uk). The draw will be carried out either live and observable on a social media page shown on the Competition Page, or automatically by our Website within seven days after the Closing Date.
8. Competition entries made via the paid online route are non-refundable, unless we cancel the Competition (see Paragraph 9).
14. The Competition Page may set out the maximum number of entries per person for that Competition.
15. Conduct contrary to the spirit or intention of the Competition may lead to disqualification at our absolute discretion.
16. Payments for Competition entries, and moneys held as credit in a digital wallet, are non-refundable but may be applied to a future online Competition entry.
9. Cancellations or Extensions
9. We may cancel any Competition in the event of a force majeure event (as defined in Schedule 2), but we will then refund all entry fees.
10–16. Eligibility
10. Our Competitions are open to those 18 years of age or over and resident in England, Scotland, Wales or Northern Ireland only. Not open to: our employees, or employees of our holding or subsidiary companies; employees of our agents or suppliers professionally connected with the Competition or its administration; or members of the immediate families or households of any of the above.
11. By entering, you confirm you are eligible to enter. We may require proof of eligibility, and may conduct age verification procedures requiring photo-ID to verify identity, age and place of residence. No refund shall be made for any ineligible entry.
12. We will not accept entries we reasonably believe were: automatically generated by computer; completed by third parties or as bulk entries; illegible, altered, reconstructed, forged or tampered with; received after the Closing Date; unable to be matched to a registered entrant; or incomplete, or part of a scheme using multiple names and addresses.
13. We accept no responsibility for prospective entrants being unable to connect to our Website due to any technical or other problem. Proof of transmission does not amount to proof of receipt.
17–20. The Prize
17. The Prize will be as described on the Competition Page and, following the draw, the winning Entry Number will be displayed there.
18. The Competition Page may display an alternative cash prize, which the Winner may elect to take in lieu of the Prize. Such election must be made within five working days after the winning Entry Number is displayed or after direct contact with the Winner, whichever is later.
19. The Prize is neither negotiable nor transferable.
20. We reserve the right to substitute the Prize for a cash equivalent if the Prize becomes unavailable or if circumstances beyond our reasonable control make it necessary.
22–24. Winners
22. Our decision as to all matters where we have a discretion is final. No correspondence or discussion will be entered into.
23. After the Closing Date, we will not amend any registered contact information. We will contact the Winner as soon as practicable by email or telephone using the details provided upon registration.
24. Within 7 days after the Closing Date, we will publish on the Competition Page the name of the Winner, with the winning ticket number. The Winner may participate in any reasonable further publicity required by the Promoter at their discretion.
25–29. Claiming & Delivery of the Prize
25. Delivery of the Prize to the Winner may take up to 14 days.
26. Delivery will be in person, electronically or via a delivery service. The cost of delivery is borne by us unless stated otherwise on the Competition Page.
27. If the Winner cannot be contacted or has not claimed the Prize within 21 days after the Closing Date, we reserve the right to offer the Prize to the next eligible entrant.
28. If the Winner is unable to take up the Prize within 21 days after announcement, the Prize shall become unavailable and we shall have no further liability to the Winner.
30. Limitation of Liability
30. As far as is permitted by law, we, our agents or distributors will not be liable to compensate the Winner for any loss, damage, personal injury or death occurring as a result of taking up the Prize, except where caused by our negligence. Your statutory rights are not affected.
31–32. Intellectual Property Rights
31. All Competition entries and accompanying material become our property on receipt and will not be returned.
32. By obtaining your Entry Number, you agree to assign to us all intellectual property rights absolutely and to waive all moral rights in and to your Competition entry under the Copyright, Designs and Patents Act 1988 and equivalent legislation worldwide.
33–35. Data Protection & Publicity
33. We will process your personal information in accordance with our Privacy & Cookie Policy.
34. If the Competition offers a Prize in partnership with a third party, the Winner is deemed to consent to their email address being shared with that party. You may unsubscribe from any third party's email list at any time.
35. By registering, you agree that we may send you future promotional materials by email. You may unsubscribe at any time in accordance with our Privacy & Cookie Policy.
36–42. General
36. If there is any reason to believe you are in breach of these T&Cs, we may, at our sole discretion, exclude you from participating in any of our competitions.
37. Events beyond our reasonable control (including force majeure) may render awarding the Prize impossible. We may at our absolute discretion vary, suspend, cancel or amend the Competition and shall have no liability in such circumstances.
38. The Competition draw will be either live-streamed on social media or carried out automatically by our Website.
40. All non-compliant entries will be deemed void.
